These Terms of Service (“Terms”) govern your use of mightyphotobooths.com and any services provided by MIGHTY Photo Booths LLC (“MIGHTY,” “we,” “us”). By using our website or booking our services you agree to these Terms.

1. Services

MIGHTY provides photo booth rental, photo activation, AI experience, and related event services. Specific services, pricing, deposit requirements, cancellation terms, and event logistics are documented in the quote and signed booking agreement provided to you at the time of booking. In the event of a conflict between these Terms and a signed booking agreement, the booking agreement controls.

2. Payment

Payment terms, deposit amounts, and balance due dates are specified in your booking agreement. We accept credit card, debit card, ACH bank transfer, PayPal, and Venmo through our secure invoicing system. All prices are in US dollars and include applicable Texas sales tax where required by law.

3. Cancellation & refunds

All deposits are non-refundable. Cancellations made within 60 days of the event date, or at any time after design or production work has commenced, result in forfeiture of 100% of the total contract value — no refund of any amount will be issued. Cancellations made more than 60 days before the event date and before design work begins result in forfeiture of the deposit only. Rescheduling to a new date within 12 months incurs no penalty, subject to MIGHTY’s availability.

In the event MIGHTY is unable to perform due to circumstances beyond our reasonable control (severe weather, unsafe road conditions, venue closure, natural disaster, or similar), MIGHTY will offer rebooking at a mutually available date within 12 months. The deposit is retained to cover costs already incurred. Any balance paid beyond the deposit for an event MIGHTY was unable to service will be applied as credit toward the rescheduled date. If rescheduling is not possible, that credit remains on account for future MIGHTY services for up to 24 months. No cash refund is issued.

In the event of equipment failure, MIGHTY will make every effort to resolve the issue or deploy backup equipment within 60 minutes. If resolved within that window, no adjustment is owed. If MIGHTY is unable to restore service within 60 minutes, client will receive a prorated credit based on the portion of booked time during which service was not delivered. This credit may be applied to a future booking within 24 months. No cash refund is issued for partial service delivery. The signed booking agreement governs in any conflict with these terms.

4. Media & portfolio rights

MIGHTY retains the right to use event photos and footage for portfolio, marketing, and social media purposes unless a media blackout is requested in writing before the event. Guests and clients may use their individual photos and deliverables freely for personal, non-commercial use.

5. Limitation of liability

To the maximum extent permitted by law, MIGHTY’s total liability for any claim arising from services provided is limited to the total amount paid by the client for the event giving rise to the claim. MIGHTY is not liable for indirect, incidental, or consequential damages.

6. Website use

You may use mightyphotobooths.com for lawful purposes only. You may not attempt to access systems without authorization, scrape content at scale, style="text-decoration:underline;">Privacy Policy for how we handle your data.

7. Governing law

These Terms are governed by the laws of the State of Texas. Disputes are resolved in the courts of Tarrant County, Texas.

8. Changes

We may update these Terms as our services evolve or as required by law. The “Last updated” date at the top reflects the most recent revision.
